Who may request a due process hearing?

 

You may request a due process hearing* if you do not agree with the evaluation, identification, placement, services or Individualized Education Program (IEP). The school system also has a right to ask for a hearing when a parent refuses to give consent for initial evaluation or placement of the child into special education. The decision of the hearing officer may be appealed by either the parents or the school district by bringing a civil action in state or federal court.
